TERMS OF SERVICE
1. About us
This store is operated by Dylan Ratcliffe, trading as THE MORTALITY ARCHIVE, 18 Morton Road, Ayr, KA7 2NN, United Kingdom. Email: mujo.archive@gmail.com. By placing an order you agree to these terms.
2. Products
THE MORTALITY ARCHIVE produces limited garment runs ("drops"), some on a preorder basis and some from stock, as stated on each product page. Product images are representative. Because our garments are intentionally washed and distressed, minor variations in tone and surface between items are normal and not a fault. Sizing information is provided on each product page.
3. Orders and payment
All prices are in GBP. Prices are final at checkout; we are not currently VAT-registered and no VAT is charged or shown. Payment is taken in full at the time of order. Your order is an offer to purchase; a contract is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order (for example, suspected fraud or pricing errors), in which case you will be refunded in full.
4. Preorders and dispatch
Where a product is marked as a preorder, it is produced after the preorder window closes and dispatched within the estimated window stated on the product page and in our Shipping Policy. Estimated dates are given in good faith. If dispatch is delayed more than 30 days beyond the estimated date, you may cancel for a full refund. If a drop does not reach its minimum production quantity, we reserve the right to cancel the drop and refund all orders in full.
5. Cancellations, returns and faulty goods
Your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015 are set out in our Refund Policy, which forms part of these terms. Nothing in these terms limits your statutory rights.
6. Intellectual property
All designs, graphics, photography, text, and branding on this site and on our garments are the property of Dylan Ratcliffe. You may not reproduce, resell designs from, or commercially exploit any of our material without written permission.
7. Age
By placing an order you confirm you are at least 16 years old and legally capable of entering into a contract, or have the consent of a parent or guardian.
8. Liability
We are responsible for foreseeable loss caused by our breach of these terms, but not for loss that was not foreseeable, or business losses. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law.
9. Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control (including supplier failure, carrier disruption, customs delays), though our Shipping Policy's delay and refund provisions still apply.
10. Law and disputes
These terms are governed by the law of Scotland, and you can bring proceedings in the Scottish courts. If you live elsewhere in the UK, you may bring proceedings in your local courts.
11. Changes
We may update these terms; the version in force when you order applies to that order.
